Terms of Use

These Terms of Use ("Terms") are a binding agreement between you and Mila, a service operated by Benjamin Weissman, a sole proprietor ("Mila", "we", "us", or "our"), governing your use of the Mila mobile application and any content, features, and services made available through it (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. License to Use the Service

Subject to your compliance with these Terms, Mila grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Service and its content solely for your own personal, non-commercial Hebrew language learning. This license does not transfer any ownership to you. We reserve all rights not expressly granted.

2. Subscriptions, Free Trial, and Billing

Mila offers auto-renewable subscriptions that unlock full access to the Service. We currently offer an Annual plan (which includes a 7-day free trial for eligible new subscribers) and a Monthly plan. The exact price, billing period, currency, and any free-trial terms for each plan are displayed in the app and confirmed by the App Store before you complete a purchase. Prices may vary by region and may change over time. Payment is charged to your Apple ID account at confirmation of purchase.

Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected. If a free trial is offered and you do not cancel before it ends, your subscription will convert to a paid subscription and you will be charged. Any unused portion of a free trial is forfeited when you purchase a subscription.

You can manage your subscription and turn off auto-renewal in your Apple ID account settings after purchase. Purchases are processed by Apple and are subject to Apple's terms; refunds are handled by Apple in accordance with Apple's policies.

3. Intellectual Property and Ownership of Content

All content in the Service — including but not limited to the word entries, root analyses, translations, transliterations, grammatical explanations, binyan and smikhut data, audio recordings, the selection, arrangement, and curation of source material, and all related text, design, and software — is owned by Mila or its licensors and is protected by copyright, database, trademark, and other intellectual property laws. The compilation, structuring, and curation of this content is itself proprietary and constitutes a protected work, independent of any underlying public-domain source text. "Mila" and its logos are trademarks of Mila.

4. Restrictions on Use

The content and data that power the Service represent substantial original effort and are the core of our business. You agree that you will not, and will not permit or assist any third party or automated system to:

These restrictions survive termination of your account and these Terms. Any use of the content outside the limited license in Section 1 is a material breach of these Terms and an infringement of our intellectual property rights.

5. Accounts

To use the Service you create an account using your email address (via a one-time code) or Sign in with Apple. You are responsible for maintaining the confidentiality of access to your account and for all activity under it. You agree to provide accurate information and to keep it current.

6. Acceptable Use

You agree not to misuse the Service, including by interfering with its normal operation, attempting to gain unauthorized access to it or its related systems, circumventing any access or usage limits, or using it in violation of any applicable law.

7. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or use the Service in a manner that may cause harm to Mila or others. You may stop using the Service at any time. Sections relating to intellectual property, restrictions on use, disclaimers, limitation of liability, and governing law survive termination.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any content is complete or accurate. Mila is an educational tool and does not constitute professional, religious, or linguistic advice.

9. Limitation of Liability

To the maximum extent permitted by law, Mila will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to us for the Service in the twelve months preceding the claim.

10. Apple App Store — Additional Terms

These Terms are between you and Mila only, not with Apple Inc. ("Apple"), and Apple is not responsible for the Service or its content. The license granted to you is a non-transferable license to use the Service on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service. Apple has no obligation to provide maintenance or support for the Service. To the extent permitted by law, Apple has no warranty obligation with respect to the Service, and any claims relating to the Service (including product liability, legal or regulatory non-compliance, or consumer-protection claims) are governed by these Terms and are our responsibility, not Apple's. In the event of any third-party claim that the Service or your use of it infringes that party's intellectual property rights, Mila, not Apple, is responsible for the investigation, defense, settlement, and discharge of such claim. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts located there for any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law.
